HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.21839 OF 2010 ORDER:

The petitioners seek writ of Mandamus declaring the action of respondent bank in proposing to deduct crop insurance premium as well as weather insurance premium from the Crop Loans sanctioned or to be sanctioned at the prescribed rates for the Kharif and Rabi seasons 2010-2011 under National Agricultural Insurance Scheme as well as Weather Based Crop Insurance Scheme without the consent of the petitioners as arbitrary, irrational, oppose to debit contractual terms, unfair and without jurisdiction and violative of Articles 14 and 21 of the Constitution of India, and consequently direct the respondent not to insist upon the petitioners to pay the insurance premium on the loans advanced and to be advanced to them and pass such other order.

Today, the matter is listed under the caption 'for dismissal' and in spite of the same, there is no representation for the petitioners. It appears the petitioners are not interested to prosecute the matter. Added to it, since the relief sought for is in respect of the crop period of 2010-2011, which was over long back, the writ petition became infructuous.
