THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.874 of 2016 ORDER:
The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the 3rd and 2nd respondent in not registering the complaint, dt.27.11.2015 as illegal, arbitrary and contrary to the provisions of the Criminal Procedure Code and consequently direct the 2nd and 3rd respondent to investigate into the complaint and pass such other or further orders as the Hon'ble Court feels deem fit and proper in the facts and circumstances of the case." The Sub-Inspector of Police, Raidurgam Police Station, Cyberabad, furnished written instructions dated 28.01.
2016 to the office of the learned Government Pleader for Home, wherein he stated that no complaint was received from the petitioner in the office of the Commissioner of Police, Cyberabad. He further stated that it would always be open to the petitioner to approach the police authorities with the earlier complaint in original or any fresh complaint and action would be taken thereupon.
In the light of this stand taken by the police authorities, Sri O. Manohar Reddy, learned counsel for the petitioner, fairly stated that his client would approach the police authorities again. The writ petition is accordingly disposed of permitting the petitioner to file a fresh complaint or the original of the earlier complaint. Needless to state, in the event any such complaint is made, the police authorities are bound to take action in accordance with the law laid down by the Supreme Court in Lalita Kumari v. Government of Uttar Pradesh[1].
Pending miscellaneous petitions, if any, shall stand closed in
