ORDER
This Contempt Case is filed complaining willful disobedience on the part of the respondent in implementing the order dated 19.09.2014 passed by this Court in W.P.No.9018 of 2007. On 19.09.2014, this Court, while setting aside the order of the 2nd respondent dated 14.03.2007, for not complying with the earlier orders of this Court, directed the second respondent to consider the orders passed by this Court in proper perspective and fix the rentals in accordance with the directions issued from time to time by this court within a period of three months from the date of receipt of a copy of the order after giving opportunity of being heard to the petitioner. Learned counsel appearing for the petitioner submits that without giving opportunity to the petitioner and without complying with the spirit of the order, the second respondent issued a demand notice on 4.12.2014.
The order dated 4.12.2014 was passed pursuant to the orders of this Court on 19.09.2014. The remedy to the petitioner is to take appropriate further proceedings, but not the contempt proceedings.
In the circumstances, I see no willful disobedience of the orders passed by this Court and the Contempt Case is accordingly dismissed leaving it open to the petitioner to pursue the remedies available to him under law.
Miscellaneous petitions, if any, pending in this contempt case shall stand closed.
