HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.5366 of 2009 ORDER:

This writ petition is filed to declare the office order No.E1/468(3)/06-KR:1, dated 21-05-2007 in denying continuity of service, protection of pay and annual increments from the post of driver to shramik post to the petitioner as illegal and arbitrary.

Learned Standing Counsel for the respondentCorporation stated that the petitioner filed W.P.No.33229 of 2014 seeking direction for payment of salary from the date of appointment of Shramik from 24-01-2006 to 21-05-2007 and writ petition was disposed of directing the respondents to pay salary and other service benefits to the petitioner for the period from 24-01-2006 to 21-05-2007 within a period of six weeks from the date of receipt of copy of order in the said writ petition. In that regard, contempt case in C.C.No.1393 of 2015 was filed and it is stated that the same was closed, as order was complied with. In view of the same, the petitioner cannot maintain once again the present writ petition in respect of same cause of action, as the petitioner already sought directions for payment of his salary as Shramik.

A perusal of the order dated 06-11-2014 in WP.No.33229 of 2014 goes to show that the petitioner sought direction for payment of salary as Shramik from 24-01-2006 to 21-05-2007. In fact, the said writ petition was disposed of in favour of the petitioner and the same was implemented as per the order dated 29-03-2016 in C.C.No.1393 of 2015. Now, the petitioner cannot again claim the present relief for seeking direction for payment of salary as Shramik. In view of the same, I do not see any merit in the writ petition.

Accordingly, this writ petition is dismissed. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 09-12-2016 Nvl
