HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.16804 of 2017 ORDER:

This writ petition is disposed of at the stage of admission with the consent of both the parties.

This writ petition is filed seeking the following relief :- " ......to issue a writ, order or direction more particularly one in the nature of mandamus directing the respondents 2 to 4 to consider the petitioner's application (sent through RPAD) dated 16.3.2017 to the 2nd respondent to appear for the written test, oral and interview for absorption of his services in the 2nd respondent company....." Heard Mr.B.Ramesh, learned counsel for the petitioner and the learned Standing Counsel for the respondents. It has been contended by the petitioner that he is fully eligible and qualified to be appointed as an Electrician and he has worked with the respondents as an apprentice from 2001 to 2002 and he is a member belonging to scheduled caste community.

After successfully completing his tenure of apprenticeship, he was engaged as an Electrician on contract basis with the respondents from 2002 to 2007. While so, the respondents have issued Notification on 14.02.2017 calling for applications from all the contract employees, who worked earlier with the respondents. Pursuant to the said Notification, the petitioner has submitted an application to the respondents on 16.03.2017 and the same is pending.

Learned counsel for the petitioner submits that though the petitioner is fully qualified and eligible to be absorbed as an Electrician, the respondents are not considering his case for

absorption. Therefore, appropriate orders be passed in the writ petition directing the respondents to consider the case of the petitioner for absorption as an Electrician by duly considering and disposing of the application submitted by the petitioner on 16.03.2017.

Learned Standing Counsel appearing for the respondents contends that the respondents would verify the application submitted by the petitioner on 16.03.2017 and pass appropriate orders in accordance with law.

This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the petitioner to submit a fresh representation to the respondents within a period of two weeks from the date of receipt of a copy of this order. Upon such representation being received, the respondents shall consider the same and pass appropriate orders in accordance with law within a period of eight weeks thereafter. With the above observations, the writ petition is disposed of. No order as to costs.
