This petition is filed under Section 438 Cr.P.C. to grant anticipatory bail to the petitioners-A3 and A5 for the offences alleged under Sections 420, 406, 409 and 471 r/w 34 IPC. 2.

Heard learned counsel for the petitioners, learned Additional Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioners would submit that the petitioners were falsely roped in this case. They have not taken any loan. They have not fabricated any document to obtain loan and ultimately prayed to grant bail to the petitioners.

Learned Additional Public Prosecutor opposed for grant of bail to the petitioners.

The material on record reveals that these petitioners obtained loan of Rs.28.69 lakhs on 25.02.2015 and Rs.27 lakhs on 02.03.2015 from State Bank of India, Pulivendula branch. The documents filed by the petitioners are forged one. Further the purpose of the loan was to establish garment manufacturing unit. But, they did not do so. The allegations are grave. The matter requires thorough investigation.

Under these circumstances, it is not a fit case to grant bail to the petitioners under Section 438 Cr.P.C. 7.
