THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.152 OF 2013 JUDGMENT:
This Second Appeal is filed under Section 100 of C.P.C. by the defendant assailing the judgment and decree dated 04.06.2012 passed in A.S.No.264 of 2010 on the file of the Court of the I Additional District Judge, Ranga Reddy District at L.B.Nagar, Hyderabad, wherein and whereby the judgment and decree dated 22.07.2010 passed in O.S.No.2254 of 2008 on the file of the Court of the Principal Senior Civil Judge, Ranga Reddy District at L.B.Nagar, Hyderabad, decreeing the suit filed by the plaintiff for perpetual injunction was confirmed.
Learned counsel for the appellant submitted that he has addressed a letter to the appellant to engage another counsel and also given no objection to that effect.
This appeal was dismissed for default in the year 2013 and restored. It seems that the appellant is not interested to prosecute the matter.
Hence, the Second Appeal is dismissed. There shall be no order as to costs.
Consequently, Miscellaneous Petitions, if any, pending in this Second Appeal shall stand closed.
