THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.7089 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the inaction of the Respondents No.2, and 3 herein, in examining Petitioner's representation dated 06-08-2015, and passing appropriate orders appointing the Petitioner as contract faculty in Computer Science in the existing vacancies at SCNR Government College, Proddatur, Kadapa District, as illegal, arbitrary, unconstitutional, malafide and to consequently pass appropriate orders directing the Respondents herein to consider Petitioner's representation dated 06-08-2015 and appoint the Petitioner forthwith as contract faculty in Computer Science in any existing vacancies in any college in Zone IV, Kadapa District."

Heard, Mrs.S. Nanda, learned counsel for the petitioner and learned Government Pleader for Education for respondents. The grievance of the petitioner in the present writ petition is non-consideration of her representation, dated 06-08-2015, wherein she requested for consideration of her case for appointment as contract faculty in Computer Science in the existing vacancies in SCNR Government College, Proddatur, Kadapa District.

The material before this Court reveals that the petitioner herein submitted a representation on 06-08-2015 to the Commissioner of Collegiate Education, Hyderabad for redressal of

her grievance. On the said representation the Commissioner of Collegiate Education, Hyderabad issued a Memo bearing No.176/Ser.II-1/2015, dated 01-10-2015 requesting the 3rd respondent to take necessary action in the matter as per rules invoked.

The complaint of the petitioner is that despite the said memo issued by the Commissioner of Collegiate Education, Hyderabad no action whatsoever has been taken by the 3rd respondent in the direction of redressal of the grievance of the petitioner. Having regard to the nature of controversy and in the facts and circumstances of the case, this Court is of the considered opinion that the ends of justice would be met if the respondents 2 and 3 are directed to take consequential action pursuant to the Memo bearing No.176/Ser.II-1/2015, dated 01-10-2015 by fixing some timeframe.

For the aforesaid reasons, the writ petition is disposed of, directing the respondents 2 and 3 to take consequential action pursuant to the Memo bearing No.176/Ser.II-1/2015, dated 01-102015 and pass appropriate orders, in accordance with law, within a period of one month from the date of receipt of a copy of this order.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
