THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.42715 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to quash the charge sheet in C.C.No.166 of 2016 on the file of Judicial Magistrate of First Class, Uravakonda, Anantapuram District, during pendency of civil litigation in O.S.No.39 of 2015 on the file of Junior Civil Judge, Uravakonda and F.I.R.No.120 of 2015, dated 02.11.2015 registered for the offences punishable under Sections 147, 323, 324, 509, 447 and 448 read with 34 IPC.

Heard and perused the material available on record. 3.
After arguing for some time, when this Court informed that this Court is not inclined to interfere with the trial on the basis of the disputed fact, then the learned counsel for the petitioner confined his argument only in connection with the presence of the petitioner before the trial Court.

Considering the facts and circumstances of the case and without going into the merits of the case, the presence of the petitioner before the trial Court is dispensed with except on the dates of framing of charges, if any, examination under Section 313 Cr.P.C., and also on the date of pronouncement of judgment. The petitioner shall be properly represented through his counsel before the trial Court.
