HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY Writ Petition No. 39628 of 2012 ORDER :

This writ petition is filed seeking writ of mandamus directing the 2nd respondent to take necessary action against the 1st respondent for negligence and dereliction of duty and further direct the respondents to submit report before this Court.

2. The grievance of the petitioner is that the respondents are not providing water connection to the premises owned by the petitioner.

3. Heard Sri Ancha Panduranga Rao, learned Standing Counsel for the 2nd respondent Corporation.

4. On 02.01.2013, this Court recorded the statement of the learned Standing Counsel for the respondent Municipal Corporation as follows: "Learned Standing Counsel for Nellore Municipal Corporation assures this Court that the necessary water connection would be provided to the petitioner within two weeks from today." Now, counter affidavit is filed by the respondents stating that on the representation of the petitioner for sanction of BPL water tap connection to his house, on payment of requisite fees on 01.09.2005 and 06.04.2006, the then Municipal Engineer Sri K.J.Upendra Singh had already sanctioned the BPL Water tap connection to the petitioner and issued a work order to the petitioner for execution of the tap connection on 27.05.2006. That as per the note orders dated 02.07.

2007 of the concerned Fitter, concerned Assistant Engineer, concerned Deputy Executive Engineer, the petitioner has refused to take the work order and subsequently, water tap connection was provided to the house of the petitioner on 19.01.2013. Since petitioner has already been provided with water connection, nothing survives for consideration in this writ petition.

In view of the categorical averments in the counter affidavit, this

writ petition is disposed of accordingly.

There shall be no order as to costs. As a sequel thereto, miscellaneous applications, if any pending in this Writ Petition, shall stand dismissed.
