HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION NO. 40368 OF 2015 ORDER:

The petitioner is a Field Assistant. Vide proceedings dated 21.6.2015, the third respondent herein, imposed punishment of removal against the petitioner. Aggrieved by the order of removal, the petitioner herein preferred an appeal before the District Collector-cum-Appellate Authority, District Convener Mahatma Gandhi NREGA, Srikakulam on 13.7.2015. It is alleged that the said appeal is yet to be disposed. Challenging the order of removal the present Writ Petition is filed.

Having regard to the fact that the petitioner has already availed the remedy of appeal as provided by the Human Resources Policy governing Field Assistant Posts and circular instructions issued from time to time, the Writ Petition is disposed of without expressing any opinion on this matter, directing the District Collector -cum- Appellate Authority, District Convener Mahatma Gandhi NREGA, Srikakulam, to pass orders on the appeal preferred by the petitioner on 13.7.2015, as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There

shall be no order as to costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
