Heard learned counsel for the petitioner and learned Government Pleader for Revenue (Telangana).

With the consent of both parties, the Writ Petition is disposed of at the admission stage.

The present Writ Petition came to be filed seeking issuance of Writ of Mandamus declaring the action of the third respondent in forcing the petitioner to evict from the land admeasuring Acs.2.20 cents in Survey No.138/1553/A/1, situated at Manuguru village, Bhadrachalam Division, without any proceedings or any notice, as illegal and arbitrary. 4.

The grievance of the petitioner is that though he has been issued pattadar pass book, the third respondent is trying to dispossess him on the ground that land, which is in possession of the petitioner, is a Government land.

Learned Government Pleader for Revenue would submit that if the petitioner is in possession, any action to be taken against him, would be in accordance with law.

Recording the said submission, the Writ Petition is disposed of directing the third respondent to follow due process of law, if the eviction of the petitioner has to be effected. 7.
