Petitioner/ A-22 seeks regular bail in Crime No.11 of 2012 of Police Station, Pasra, Warangal Rural wherein the petitioner and other accused alleged to have committed offences punishable under Sections 406, 420 IPC r/ w 34 IPC and Section 5 of A.P.P.D.F.E. Act, 1999 and Sections 4, 5 (a) (b) (c) (d) (e) (f) of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978.
The complainant Barawath Lakshmi lodged a report with the police of Pasra Police Station alleging that A-10 approached her and stated if she deposits Rs.10,500/ - she would get @ Rs.2,500/ - per month for 10 months and on his inducement she paid Rs.10,500/ - in October,2011. Thereafter, he paid only Rs.2,500/ - per month and thereafter, he did not pay any amount. When asked, he stated that he gave the amount deposited by her to A-9 and he absconded. On enquiry, she came to know that many persons were deceived in similar fashion. On complaint, the above crime was registered and investigated into and during the course of investigation, the police have booked the case against A-1 to A-22. The petitioner is accused No.22. Originally the petitioner/ A-22 was arrested in a similar case arising out of Crime No.
383 of 2012 of Police Station, Gatkesar and on P.T. warrant he was produced in the present crime on 11.04.2017 and was remanded to judicial custody. In the confessional statement, he allegedly admitted that he along with other accused collected amounts from the devotees of Church and cheated them. Investigation is reported to be pending. Bail is pleaded mainly on the ground that the petitioner is innocent and investigation is almost completed.
Learned Addl.P.P. while opposing bail would submit that the accused involved in series of cases which are all in crucial stage of investigation and at this stage, if bail is granted, he and other accused would meddle with investigation.
As can be seen, the petitioner/ A-22 was originally arrested in Crime No.383 of 2012 of Gatkesar Police Station and on P.T. warrant he was produced in the present crime and remanded to judicial custody which manifests, he is involved in a number of similar cases. C.D. shows only 7 witnesses are examined and charge sheet is not yet filed. Learned Addl.P.P. would submit that the cheated amount is around Rs.72 lakhs and the police are investigating about the complicity of some more persons. Under these circumstances, it is not a fit case to grant bail.
Accordingly, bail application is dismissed.
