THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14306 OF 2025 ORDER :
This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, by the petitioner/A.1 seeking anticipatory bail in connection with Crime No.672 of 2025 of Mancherial Town Police Station, Ramagundam District. The offences alleged against the petitioner are under Section 69 of Bharatiya Nyaya Sanhita 2023.

The case of the prosecution is that the defacto complainant lodged a complaint on 30.10.2025 stating that she met the petitioner in 2022, thereafter she developed acquaintance with him and under the guise of promise of marriage the petitioner induced her and physically exploited. Recently when she asked for marriage he refused to marry her and now engaged with another woman. As such, requested the police to take necessary action against the accused. Basing on the said complaint, the police registered the case against the accused for the said offence.

Heard Sri M.V.Hanumantha Rao, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State.

The contention of learned counsel for the petitioner is that the relationship between the parties is a consensual relationship. As the complainant is engaged with other person, the relationship between the petitioner and complainant is broken. The complainant is sufficiently matured person and she is well aware of the consequences thereof, and there is no such inducement under the promise of marriage. The marriage of petitioner is fixed on 13.11.2025. As such, requested this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that there are clear allegations against this petitioner and the offence committed is a heinous offence. If the marriage of the petitioner is performed it will cause prejudice to the complainant. As such, requested this Court to dismiss this criminal petition.

Considering the submissions made and the material on record, the averments in the complaint shows that the victim and the petitioner are in relationship from the year 2023 and recently she lodged complaint before police on 30.10.2025 on the allegation of false promise of marriage he physically exploited her. However, considering the relationship between the parties and the facts and circumstances of the case, this
- 3 - Court deems it fit to grant bail to the petitioner subject to the following conditions :
i.
The petitioner/A.1 shall surrender before the Station House Officer, Mancherial Town Police Station, Ramagundam District, within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner on bail on his executing a personal bond for Rs.25,000/- (Rupees Twenty five Thousand only) with two sureties, for the like sum each.
ii.
The petitioner/A.1 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.
iii.
The petitioner/A.1 shall abide by the other conditions stipulated in Section 482(2) of BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
