THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40409 OF 2016 ORDER:

This writ petition is filed by the petitioners seeking to declare the action of respondent No.2 in not granting protection to their household properties in Survey No.52 of Naspur Shivar, Naspur Mandal, Mancherial District by taking legal action against the unofficial respondents, who are violating the Court decrees, as illegal and arbitrary.

It is stated in the affidavit that though the petitioners are decree holders in O.S.Nos.689 of 2006, 494 of 2006 and 495 of 2006 on the file of the Junior Civil Judge, Mancherial, Adilabad District with regard to subject property, respondent Nos.3 and 4 created fake and fabricated documents in the name of respondent Nos.5 to 8 and all of them trespassed into the said property and threatened them with dire consequences and also tried to kill them by abusing in filthy language. Therefore, the petitioners filed written complaints on 9.7.2014 and 9.11.2016 before respondent No.2 - The Station House Officer, CCC Naspur Police Station, Mancherial District for police protection, but no action has been taken thereon. Hence, the writ petition.

Heard both sides and perused the material on record. 4.

Considering the facts and circumstances of the case and in view of the civil disputes between the parties, without going into the merits of the matter, I deem it appropriate to direct respondent No.2 to take appropriate decision on the complaint, dated

9.11.2016, filed by petitioners if there is a threat of their lives and pass appropriate orders in accordance with law. 5.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
