THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.737 of 2015 ORDER:
This Writ Petition is filed challenging the inaction of the respondents in considering the petitioners' representation dated 24.11.2014 in respect of digging the fish tanks by private persons.
The private persons who are digging the land are not made parties to the present Writ Petition. But, at the time of arguments, learned Counsel for the petitioners submits that he got information with regard to the persons, who are digging the land, and it shows that they got some permission. However, he submits that the details of permission are not available to him at this point of time. In the circumstances, he submits that if the Writ Petition is disposed of directing the respondents to consider the petitioners' representation dated 24.11.2014, it would meet the ends of justice. In the circumstances, the Writ Petition is disposed of directing the second respondent to consider the representation alleged to have been submitted by the petitioners on 24.11.
2014 in respect of digging the fish tanks in various survey numbers in Nelamuru Village, Penumantra Mandal in West Godavari District, within a period of fifteen days from the date of receipt of a copy of this order. However, the petitioners are at liberty to challenge the permission granted to the private parties for digging the fish tanks, if they are so advised. The Writ Petition is disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.
