THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 5404 and 5662 of 2017 COMMON ORDER:
Both the writ petitions are being disposed of by this common order as they are filed by the owner and tenant of the premises bearing No.3-6-262/8, Tirumala Estates, Himayathnagar, Hyderabad.
It appears that the tenant filed W.P.No.5662 of 2017 against the forcible locking of the said premises by respondent Nos.2 and 3 and that he was involved in Crime Nos.17 and 23 of 2017, registered by the Station House Officer, Narayanaguda Police Station, Hyderabad, whereas the owner filed W.P.No.5404 of 2017 challenging the action of the Station House Officer, Narayanaguda Police Station in withholding the key of the said premises. Now, the learned Government Pleader for Home, on the basis of written instructions, submits that the Police never withheld the key of the premises and it is not required for the purpose of investigation in the above said cases.
In view of the above, it is open to the parties to work out their remedies in accordance with law as the Police are denying withholding the key in respect of the premises in question.
The writ petitions are accordingly disposed of. Miscellaneous petitions, if any, pending in these writ petitions shall stand closed. There shall be no order as to costs. ________________________ A.RAMALINGESWARA RAO,J Dt:20.02.2017 kdl
