THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.32175 OF 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed challenging the action of the 2nd respondent in addressing a letter, dated 10.03.2017, directing the 5th respondent to seize 2000 MTs. of edible oil in relation to a case in Crime No.27 of 2015 on the file of the 2nd respondent Police Station, which was subsequently transferred to the 3rd respondent Police Station and renumbered as a case in Crime No.174 of 2017, as illegal, arbitrary, unconstitutional and without jurisdiction and to set aside the same and consequently, direct the 5th respondent to release the above said stock.

At the hearing, a joint representation was made that the subject matter and the issue involved in the present Writ Petition are squarely covered by the orders, dated 17.08.2018, of this Court in W.P.No.28455 of 2018. A copy of the said order is placed on record. Having regard to the submissions and for the reasons alike as were mentioned in the said order, this Writ Petition is also allowed in terms of the said order.

Accordingly, there shall be a direction to the 5th respondent to release the stocks of the petitioner, which were seized as per the letter, dated 10.03.2017.

There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
