.. Respondents This court made the following :
- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.33277 OF 2012 ORDER :
Heard learned counsel for the petitioner and learned Government pleader for Women Development and Child Welfare for respondents.
2.
In November, 2011 a recruitment notification was issued to fill up the post of Anganwadi Worker of Marellamadaka Village, Chakraipeta Mandal, Y.S.R.
District.
Petitioner responded to the said notification and was found suitable. This writ petition is filed alleging inaction in taking further steps in finalizing the selections and appointing the petitioner, as arbitrary and illegal.
3.
This Court by order dated 18.10.2012 directed maintenance of status quo obtaining as on that date. 4.
In the counter affidavit filed on behalf of 1st respondent, it is averred that in response to the recruitment notification two applications were received, including the application of petitioner and petitioner was the only eligible candidate for employment. However, it is averred that petitioner was not appointed on the ground that there are certain allegations against her of forging the signature of M.Bujji, who was an Anganwadi helper and claiming salary in the name of M.Bujji. 5.
Though averments refer to the alleged forging of signature and claming remuneration in the place of M. Bujji, as stated by learned counsel for the petitioner, no further proceedings were taken against the petitioner nor crime was registered against her
- 3 - on the alleged issue. In the counter affidavit it is also stated that lenient view was taken and no crime was registered. Thus, there was no legal impediment in finalizing the selections in pursuant to November, 2011 notification and appointing the petitioner, when she was found to be otherwise suitable and qualified and by merely referring to an incident of petitioner claiming remuneration by forging the signature of M.Bujji which is not proved.
6.
Having regard to the above discussion, the Writ Petition is allowed and the respondents are directed to take consequential steps in furtherance to the selections made in the year 2011 to the post of Anganwadi Worker of Marellamadaka Village, Chakraipeta Mandal, Y.S.R. District. Pending miscellaneous petitions shall stand closed.
