GANGA RAO Writ Petition No.31690 of 2017 ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) None appears for the petitioner. Sri N.V.Subba Raju, Learned Counsel for the respondent-Bank, would submit that, while the auction was held on 18.09.2017, pursuant to the e-auction notice dated 08.08.2017, no bidders participated in the said auction; and the respondent-Bank would issue a notice afresh fixing the date of auction for sale of the secured asset.
As no bidders have come forward to participate in the auction held on 18.09.2017, it is evident that the cause in the Writ Petition does not survive necessitating any further adjudication by this Court. Suffice it to make it clear that, in case any notice is issued afresh by the respondent-Bank, this order shall not disable the petitioner from questioning the same in appropriate legal proceedings.
The Writ Petition stands disposed of accordingly.
Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
