HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION NO. 31979 OF 2018 O R D E R :

This Writ Petition is filed invoking the inherent jurisdiction of this Court under Article 226 of the Constitution of India seeking mandamus to declare the action of the second and third respondents in not receiving the application for building permission in respect of the petitioner's house bearing No. 8-2-293/82/C/124/A/2 admeasuring 264 sq.yards equivalent to 221.76 sq.mts situated at Krishna nagar basti, Shaikpet village, Hyderabad by insisting upon to produce "No objection Certificate", issued by the District Collector/Joint Collector as illegal, arbitrary, without jurisdiction and in violation of Article 14 of the Constitution of India and also against the provisions of the Hyderabad Municipal Corporation Act, 1955 and consequently to direct the second and third respondents to receive the aforesaid application of the petitioner and grant her building permission and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.

2. Heard Ms.Divya, learned counsel appearing for the petitioner and the learned Government Pleader for Municipal Administration and Urban Development [TG] and perused the record.

3. It is submitted by the learned counsel for the Respondent-Corporation that the process of making applications is now made on-line. It is also stated by the learned Government Pleader that the Respondent-Corporation is also not insisting for "No objection Certificate".

4. Therefore, it is open for the petitioner herein to file application on-line for building permission and if the same is submitted on-line, the same shall be considered strictly in accordance with law and appropriate orders be passed forthwith and communicate the same to the petitioner under due and proper acknowledgement.

5. With the above direction, the writ petition is disposed of at the stage of admission. No costs.

6. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
