ORDER:

Petitioner, who is a fair price shop dealer of Shop No.7, Angadi

Bazar, Mandamarri Town, Adilabad District, states that as against the order passed by the Revenue Divisional Officer, respondent No.3 herein, dated 20.12.2014 cancelling the petitioner's dealership, petitioner has already filed an appeal before the second respondent.

In the said appeal, by order dated 03.01.2015, the order of the RDO has been stayed pending appeal. The present writ petition is filed with a grievance that in spite of the aforesaid interim order granted by the second respondent, the third respondent is not implementing the said order.

2. I have heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies.

3. I do not see any reason as to why the third respondent should not implement the order of the second respondent, when as an appellate authority, the second respondent has granted interim order in favour of the petitioner. The third respondent is, therefore, directed to implement the aforesaid order and report compliance before the appellate authority. The writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. _____________________ VILAS V. AFZULPURKAR, J January 23, 2015 DSK
