THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.19491 OF 2016 ORDER:
Heard the learned counsel for the petitioners and the learned Government Pleader for Home. With consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage.
2 . The present writ petition came to be filed seeking issuance of writ of mandamus declaring that the action of respondents 3 and 4 in harassing the petitioners by making them to sit in the police station for hours together without registering any case, as highly illegal and arbitrary and consequently, to direct the respondents not to harass the petitioners by way of calling them to the police station unless they register a case against the petitioners and issue notice under Section 41A Cr.P.C.
3. Learned counsel for the petitioners submits that though no crime is registered, till date the petitioners are being summoned to the police station and are made to sit for hours together, which is contrary to law.
4. Learned Government Pleader for Home submits that the allegations made are false and that no action will be taken by the respondent authorities without following due process of law.
5. Having regard to the circumstances stated above, the Writ Petition is disposed of directing the 3rd respondent- Women Police Station, Central Crime Station, Hyderabad, not to summon the
petitioners except in accordance with law.
Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
