Learned counsel for the petitioner seeks permission of this Court to withdraw the present Writ Petition since the remedy is available to him in A.S.No.59 of 2012. Accordingly, the Writ Petition is dismissed as withdrawn giving liberty to the petitioner to pursue the remedy available to him as per law.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
