Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies for the respondents. 2.

On 10.04.2016, a notification was issued calling for applications for enlistment as fair price shop dealers in shop bearing No.16, Vasanthapur Village, Chittoor District. Petitioner responded to the said notification and was short listed for oral interview. Alleging that even though petitioner is selected, he was not appointed, this writ petition is filed. 3.

This Court by order dated 01.03.2017 directed the respondents to take further action pursuant to the interview held in terms of the notice dated 18.04.2016. 4.

In the counter affidavit filed on behalf of the respondents, it is averred that the earlier notification was cancelled and fresh notification for enlistment of dealer to the very same shop was issued on 01.08.2016. Petitioner did not apply to the said notification, selections were finalized and one Sri G.Ranganadham was appointed as permanent fair price shop dealer to fair price shop No.16.

Learned counsel for the petitioner sought to contend that not appointing the petitioner based on some illegal complaints against him is arbitrary.

However, this Court is not inclined to go into those submissions, as apparently the earlier notification was cancelled; fresh notification was issued, and in pursuant thereof, another person was selected and dealership authorization was granted to him as early as on 06.10.2016. The subsequent notification and the candidate who was selected for grant of authorization was not made a party to this writ petition.

Having regard to the above, the Writ Petition is dismissed leaving it open to the petitioner to work out his remedies, if so advised, against subsequent notification and appointment of another person as a dealer. Pending miscellaneous petitions shall stand closed.
