This Writ Petition is filed for a Mandamus to declare the seizure of 40 quintals of rice of petitioner No.1 and 35 quintals of rice of petitioner No.2 pursuant to Mediator's report, dated 04.04.2009, and the consequential action of respondent No.1

in proceeding with the disposal of the seized rice in open market, as illegal and unjust. The petitioner sought for a consequential direction to the respondents to release the rice to the petitioners forthwith.

At the hearing, Mr.Ch.Venkatanarayana, learned Counsel representing Mr.B.Devanand, learned Counsel for the petitioners, submitted that the cause in this Writ Petition does not survive for adjudication and that the Writ Petition has become infructuous.

The above-submission of the learned Counsel for the petitioners is placed on record and the Writ Petition is, accordingly, dismissed as infructuous.

As a sequel to dismissal of the Writ Petition, WPMP.No.9973 of 2009, filed by the petitioners for interim relief, is disposed of as infructuous.
