ORAL ORDER:

In WP No.2245 of 2016, petitioner challenged the orders of the Superintendent, Rajiv Gandhi Institute of Medical Science, General Hospital, Srikakulam, advising Agile Security Forces Pvt Ltd to terminate the services of petitioner, which resulted in termination of service of the petitioner. This Court disposed of said writ petition 28.1.2016 setting aside the order impugned, however, left it open to security agency to take up appropriate action as warranted by law.

Alleging that the said order is not complied with, this contempt case is filed.

Bare perusal of the order would show that what is set aside is direction/advise of the Superintendent to the security agency to terminate the service of the petitioner. Once this order goes, it is for the security agency/employer of the petitioner to take further course of action. If the employer does not restore the petitioner to duty, petitioner has to work out his remedies independently. In the facts of this case, it cannot be said that the respondents in the contempt case violated the orders of this Court and committed contempt of the Court orders.
