HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.21121 OF 2016 ORDER:
This petition is filed for a writ of Mandamus declaring the suo moto revision before the 3rd respondent in File No.D1/6972/2015 as in violation of Section 9 of the A.P.Rights in Land and Pattadar Pass Books Act, 1971, Rule 23(2) of A.P.Rights in Pattadar Pass Books Rules, 1989, violation of Section 10 of C.P.C and also in violation of principles of Natural Justice, illegal and arbitrary.
Along with the writ petition no proceedings are filed by the petitioners to show that any notice was issued to them by the respondents exercising power of revision under Section 9 of the A.P.Rights in Land and Pattadar Pass Books Act, 1971. Learned counsel for the petitioners only pointed out the proceedings dated 03.10.2015 addressed to the Collector by the 2nd respondent requesting to take up the matter under suo moto revision under Section 9 of the A.P.Rights in Land and Pattadar Pass Books Act, 1971. The proceedings dated 03.10.2015 is the internal communication between the 2nd respondent and the District Collector. In view of the same, the writ petition is premature and the same is dismissed. No order as to costs.
As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
