THE HON'BLE SRI JUSTICE S.V.BHATT C.R.P.No.5229 of 2018 ORDER:
Heard Mr.R.Nagarjuna Reddy for revision petitioners. Plaintiffs are the revision petitioners. The revision is directed against the order dated 02.07.2018 in C.M.A.No.22 of 2017. The learned trial Judge in I.A.No.747 of 2015 granted temporary injunction in favour of the petitioners. The respondents assailed the order in I.A.No.747 of 2015 by filing C.M.A.No.22 of 2017. The learned Principal District Judge, keeping in view the assertion made by the petitioners herein and also the reply of respondents herein, found that in the case on hand, detail examination of documents is necessary, therefore found that accepting the case of revision petitioners herein is untenable. Through the order under challenge allowed the C.M.A. Hence, the Civil Revision Petition.
Mr.Nagarjuna Reddy contends that for the limited purpose of granting interlocutory prayer, the trial Court in fact considered all the documents which have bearing on the case pleaded by both the parties and observation of appellate Court is very casual. He firstly prays for setting
aside the order under revision and secondly prays for expeditious disposal of the suit.
Learned counsel for the petitioners fairly draws the attention of the Court to the sets of documents relied on, by both the parties. The suit is one for perpetual injunction. Instead of examining each one of the documents at this stage, ends of justice are met by directing the trial Court to dispose of the suit as expeditiously as possible, preferably within six (06) months from the date of receipt of copy of this order.
Civil Revision Petition is disposed of with the above direction. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
