THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.31929 OF 2018 ORDER:

When the matter is taken up for hearing, it is submitted by the learned counsel for the petitioner that the issue involved in the writ petition is squarely covered by the order of this Court in W.P.No.28109 of 2018 dated 16.08.2018 and a copy of the same is placed on record along with the writ petition as material paper. Following the above said order and for the reasons recorded therein, this Writ Petition is also allowed, setting aside the impugned order passed by the Deputy Director of Mines and Geology/R.3 issued vide proceedings No.1254/QL/SRD/2018, dated 28.07.2018. However, it is open for the State Government to initiate action and to pass appropriate orders, if they are so advised to do so, in accordance with the provisions of Rule 11 of the Telangana State Minor Mineral Concession Rules, 1966. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
