HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 32241 of 2018 ORDER:
1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage itself.
2) The present writ petition came to be filed questioning the action of the third respondent in trying to interfere with the construction work, which is being carried out, in accordance with the sanctioned plan vide permit No.3/C19/12771/2017, dated 18.12.2017, issued by the Greater Hyderabad Municipal Corporation, Hyderabad, over the land under premises bearing municipal No.8-1-299/75 admeasuring 225 square yards, situated at Al-Hamra Colony, Shaikpet village and Mandal, Hyderabad. 3) Learned counsel for the petitioner would submit that though the petitioner has the sanctioned plan, the third respondent is trying to interfere with the construction work. On the other hand, learned Government Pleader would submit that the land where construction is said to be going on is a ceiling surplus land, however, pleads that any action taken will be in accordance with law.
4) Having regard to the above, the Writ Petition is disposed of directing the respondents not to interfere with the constructions, if any made in the said land, if the same is in accordance with the approved plan. Further, any action of interference by the respondents over the land in dispute shall only be in accordance with law.
