THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14355 OF 2025 ORDER :

This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused seeking enlargement on bail in connection with Crime No.930 of 2025 of Bachupally Police Station, Cyberabad Commissionerate. The offences alleged against the petitioner are under Section 80 of Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS').

The brief facts of the case are that, on 14.09.2025, the defacto complainant, who is the mother of the deceased, lodged a report with the police stating that on 13.09.2025, she received a call from the petitioner informing her that her daughter had committed suicide by hanging herself. She immediately went to the scene and confirmed that her daughter had indeed taken her own life. According to the complainant, the petitioner had been harassing the deceased for additional dowry. She further stated that they had already given the petitioner Rs.20,00,000/- and 48 tulas of gold. Due to this alleged harassment, her daughter committed suicide. Therefore, the complainant requested the police to take appropriate action against the accused. Based on the said

- 2 - complaint, the police registered a case against the accused for the aforementioned offence.

Heard M. Keshav Yadav, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State.

The contention of learned counsel for the petitioner is that the petitioner is innocent of the allegations made against him and has been in judicial custody since 15.09.2025. He further submitted that the petitioner married the deceased in the year 2024 and that the deceased was previously married to another person, and they separated by mutual consent before she married the petitioner. The marriage between the petitioner and the deceased was a love marriage, and there was no demand for additional dowry. Furthermore, he stated that the material part of the investigation has already been completed. Therefore, prayed this Court to grant bail to the petitioner.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner are grave in nature and that the deceased committed suicide solely due to the harassment for additional dowry by the petitioner and

- 3 - that the investigation is still ongoing. Therefore, prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it is evident that the petitioner has been in judicial custody since 15.09.2025. As recorded in the remand case diary, prosecution witnesses LWs.1 to 14, including the investigating officer, have already been examined. Considering the overall facts and circumstances of the case, including the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner-accused, subject to the following conditions:

i.

The petitioner-accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned III Additional District Judge, Kukatpally.

ii.

The petitioner-accused shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier,

- 4 - for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner-accused shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).
