THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION No.31294 of 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner to declare the inaction of the respondent Nos. 2 to 4 in not considering the objections raised by the petitioner for mutation of the names of the unofficial respondent Nos. 5 to 8 in the Record of Rights relating various survey numbers under the Act and direct respondent No.4 to consider his objections in accordanc e with law. It is the contention of the learned counsel for the petitioner that there were disputes between respondent Nos. 5 to 8 and the petitioner regarding rights in the immovable property, but without notice to the petitioner, respondent Nos.

5 to 8 are making efforts to mutate their names in the Record of Rights maintained by the Revenue Authorities without resolving the disputes and therefore, the petitioner raised objections in Writing starting from to till 2016, but the Tahsildar/ Respondent No.4 still did not consider the objections. The learned Government Pleader for the State of Telangana requested this Court to direct Respondent No.4 to consider the objections submitted by the petitioner on various dates and pass appropriate orders in accordance with law.

Acceding to the request of the learned Government Pleader for the respondent, this Writ Petition is disposed of with a direction to respondent No.4 to take into consideration of the objections raised by the petitioner while passing Orders for mutation of the names of respondent Nos. 5 to 8 in the Record of Rights since the decree or judgment passed in

any Court is final under Section 8 (2) of the Act and even any entry made is depends upon the result in the suit/ s filed, pending and dispose of, if any.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
