HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 31976 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the 4th respondent in directing the petitioner and respondents 5 to 10 to appear before him for enquiry with regard to mutation of names in the revenue records in respect of property in Sy.No.200 to an extent of Ac.22.25 cents, in Sy.No.269 to an extent of Ac.3.50 cents and in Sy.No.414 to an extent of Ac.1.23 cents situated at Nagasamudram Village, Guntakal Mandal, Anantapur District, inspite of pendency of title dispute in O.S.No.216 of 2017 on the file of the Senior Civil Judge, Gooty, as illegal and arbitrary.

2) The grievance of the petitioner appears to be that though there is a civil dispute between the petitioner and un-official respondents, the 4th respondent is calling the petitioner to his office and asking him to produce the documents evidencing his title over the property. But it is to be noted here that when the civil Court is ceased of the issue vide O.S.No.216 of 2017 on the file of the Senior Civil Judge, Gooty, summoning the petitioner for enquiry with regard to property, which is subject matter of civil dispute in O.S.No.216 of 2017 may not arise.

3) However, having regard to the above, the 4th respondent shall desist from calling the petitioner to the Tahsil Office, for the

purpose of enquiry on the issue which is pending before the civil Court, except in accordance with law.

4) With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. _________________________ JUSTICE C. PRAVEEN KUMAR 12.09.2018 gkv
