THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.31916 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking verbatim the following relief: "For the reasons stated in the accompanying affidavit it is therefore prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in not releasing the power supply to the petitioner buildings at premises bearing Plot Nos:1,2,22 & 23, in Sy. No:83, Venkateshwara Enclave, Jeedimetla(v), Quthbullapur Mandal, Ranga Reddy District as illegal, null, void, arbitrary and consequently direct the respondents to release the power supply without insisting for occupancy certificate and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of Justice."

I have heard the submissions of Sri N.Mukund Reddy, learned counsel appearing for the petitioner, of the learned Government Pleader for Energy (Telangana), appearing for the 1st respondent; of Sri R.Vinod Reddy, learned Standing Counsel for Southern Power Distribution Company Ltd., Telangana, appearing for the respondents 2 & 3, and of Sri Chatla Madhu, learned Standing Counsel for Greater Hyderabad Municipal Corporation, appearing for the 4th respondent. I have perused the material record.

It is stated by the learned counsel appearing for the petitioner as well as Sri R.Vinod Reddy, learned Standing Counsel appearing for the respondents 2 & 3, that the issue in this writ petition is squarely covered by the order of this Court, dated 23.03.2018, in W.P.No.9789 of 2018.

Therefore, for the reasons alike as were mentioned in the aforesaid orders, this Writ Petition is also disposed of on the same terms with a direction to the respondents to release the power supply to the premises of the petitioner subject to the compliance of the terms and conditions and on the petitioner furnishing an undertaking to produce the occupancy certificate from the Municipal Corporation concerned within a period of three (03) months. It is made clear that if no such occupancy certificate is produced within the said time by the petitioner, it is open to the respondents to take appropriate action, in accordance with law. There shall be no order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
