Heard both sides and perused the material on record. 2.

Undisputedly, pursuant to the interim order of this Court, dated 24.07.2017, in W.P.No.23462 of 2017, there was survey conducted according to the respondents on 16.08.2017. What the petitioner in the contempt case submits is that notice is contemplated pursuant to the very order of this Court before conducting survey and no such notice is given. It is not the case that pursuant to the order of this Court, survey not conducted, but for without his presence. 3.

Having regard to the above, the contempt case is closed and the petitioner is at liberty in the pending writ petition if at all to file objection to the said survey report and ask for re-survey in his presence, if necessary. Other wise, the petitioner is at liberty to file any independent writ petition for that.
