THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.5643 OF 2015 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed for the following relief:
" ...to issue a writ Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of respondent Nos.5 to 7 in not issuing Hall Tickets to the petitioners to appear Written test scheduled to be on 08.03.2015 in terms of Circular in Ref: No.CRP/PER/R/05, date 16.01.
2015 of the respondent Corporation for filing-up of vacancies in Assistant Engineer E-2 Grade in recognition of Degree Certificates of Karnataka State Open University, Manasagangotri, Mysore, an Institution approved by respondent UGC are equalant to the certificates of the other Traditional Universities/Institutions in the Country, the Degree was completed with due permission of Competent authority of respondents 5 treating them as valid for the purpose of proposed filling up of vacancies and thereby NonRecognition of such degree as illegal, unjust, Violative of Article 14 constitution of India, contrary to the provisions of University Grants Commission Act, 1956 and consequently direct the respondent Corporation to issue Hall Tickets to the Petitioners forthwith so as to enable them to appear the written Test scheduled to be held on 08.
03.2015 and pass such other order or orders as are deemed fit and proper in the circumstances of the case."
In view of the Public Notice dated 16.06.2015 bearing F.No.UGC/DEB/8/KSOU/1/2016 issued by University Grants Commission, New Delhi, the relief sought for by the petitioners cannot be granted. The said aspect is not disputed by the learned counsel for the respondent.
Having regard to the above, nothing survives for adjudication and the Writ Petition is, accordingly, closed. No costs. Miscellaneous Petitions pending in this petition, if any, shall stand closed.
