ORDER

This petition is filed by the petitioner/A-2 under Section 438 of the Code of Criminal Procedure, 1973 seeking to grant bail in the event of his arrest in connection with Crime No.3 of 2016 of Donkarai Police Station, Donkarai, East Godavari District, registered for the offences punishable under Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985. Heard and perused the material available on record. Case of the prosecution is that on 27.3.2016, the petitioner/A-2 along with A-1 supplied 800 kgs. of ganja to A-3 and A-4. Learned counsel for the petitioner submitted that the petitioner is innocent of the offences alleged against him and he has been falsely implicated in the present case on the basis of the confession of A-3 and A-4.

Even though the petitioner is arrayed as an accused basing on the confession of A-3 and A-4, this Court is of the view that custodial interrogation is necessary in this case. Further, the ganja found is more than the commercial quantity.

Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner.
