THE HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.359 of 2016 ORDER:

This application is filed to withdraw O.S.No.27 of 2009 from the Court of XXII Additional Chief Judge, City Civil Courts, Secunderabad, and transfer the same to the Court of I Additional Chief Judge, City Civil Courts, Secunderabad.

2. Heard the arguments.

3. The suit in O.S.No.27 of 2009 was originally once transferred to I Additional Chief Judge, City Civil Courts, Secunderabad, but again, due to administrative reasons of allotment of work, suit appears to have been sent to XXII Additional Chief Judge, City Civil Courts, Secunderabad, from the Court of I Additional Chief Judge, City Civil Courts, Secunderabad. The fact remains that petitioner's another suit in O.S.No.59 of 2000 is pending before the I Additional Chief Judge, City Civil Courts, Secunderabad, which is between the same parties.

4. Considering these aspects, I feel that the request of the petition for transfer can be considered.

5. Accordingly, O.S.No.27 of 2009 is withdrawn from the Court of XXII Additional Chief Judge, City Civil Courts, Secunderabad, and transferred to the Court of I Additional Chief Judge, City Civil Courts, Secunderabad, to be tried along with O.S.No.59 of 2000 in accordance with law.

The Tr.C.M.P. is ordered accordingly. No costs. Miscellaneous petitions, if any, pending in this petition, shall stand dismissed.
