This transfer civil miscellaneous petition is filed under Section 242 C.P.C to withdraw O.P.No.144 of 2016 on the file of Senior Civil Judge, Kandukur, Prakasam District and transfer the same to the Court of Senior Civil Judge, Kovur, SPSR Nellore District.

The petitioner herein who is the respondent in O.P.No.144 of 2016, filed under Section 9 of Hindu Marriage Act, 1955, sought to withdraw O.P.No.144 of 2016 on the file of Senior Civil Judge, Kandukur, Prakasam District and transfer the same to the Court of Senior Civil Judge, Kovur, SPSR Nellore District. But, it is stated that, on account of the interim order granted by this Court, the Trial Court is not permitting the respondent herein to withdraw O.P.No.144 of 2016 pending on the file of Senior Civil Judge, Kandukur, Prakasam District. When the respondent herein is intending to withdraw O.P.No.144 of 2016, the question of withdrawal and transfer does not arise and no adjudication is required in this petition. However, liberty is given to the respondent herein to withdraw O.P.No.144 of 2016 if he is interested to withdraw.

With the above observation, transfer civil miscellaneous petition is disposed of.
