THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9518 OF 2016 ORDER:
This petition is filed by the petitioners-accused Nos.1 and 3 under Section 438 Cr.P.C. seeking to grant anticipatory bail in Crime No.255 of 2015 on the file of Veldurthy Police Station, Kurnool District, registered for the offences punishable under Sections 324 r/w.34 IPC and 3 (1)(x) of the SCs & STs (POA) Act, 1989. The allegation against the petitioners is that they abused the de facto complainant in the name of his caste and also beat him. Learned counsel for the petitioner submitted that the petitioners are innocent of the offences alleged against them and as a counter blast to the case already filed by the petitioners against the de facto complaint, this complaint was lodged with false allegations. The learned Additional Public Prosecutor submitted that in view of bar under the provisions of the SC & ST Act, this petition is not maintainable.
Considering the facts and circumstances of the case and in view of the submissions made by the learned Additional Public Prosecutor, this Court is of the view that this petition is not maintainable.
