HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.42108 of 2016 O R D E R :
The Writ Petition is filed under Article 226 of the Constitution of India seeking to issue a writ or order, more particularly one in the nature of writ of Mandamus to declare the impugned order passed by the 2nd respondent in Procs.No.47/Ren./M2/Arms/Cyb/2016, dated 07-11-2016 rejecting/cancelling the petitioner's Arms Licence bearing No.20/Balanagar/153 without properly taking into consideration the explanation dated 06-09-2016 submitted by the petitioner as illegal and arbitrary and consequently set aside the same by directing the respondent No.2 to renew the Arms Licence.
The learned Assistant Government Pleader for Home informed that against the rejection of arms licence, the petitioner is having right to prefer an appeal before the Government.
Therefore, the Writ Petition is disposed of with the following directions :
The petitioner is directed to prefer an appeal before the concerned authority challenging the impugned order and till the disposal of the appeal preferred by the petitioner, the impugned order passed by the 2nd respondent is suspended. There shall be no order as to costs.
Consequently, Miscellaneous Petitions pending, if any, in the Writ Petition shall stand closed.
