ORDER:
This contempt case is filed alleging wilful disobedience of order, dated 25.11.2015, in W.P.No.26852 of 2015. As this Court was not satisfied with the action taken by the respondents as averred in the counter affidavit filed by the Assistant City Planner, Circle No.VII/B, GHMC, the case was adjourned to enable to the respondents to take appropriate steps for implementation of the orders of this Court. Accordingly, an additional counter affidavit was filed by the Deputy Commissioner, Circle No.VII/B, GHMC wherein it is inter alia stated that they have fixed 13.06.2016 for demolition of the extra floors consisting of third floor and pent house in the fourth floor and that the respondents could demolish the pent house on 13.06.2016 and the third floor on 15.06.2016 and 17.06.2016
with the police protection. In support of these averments, several photographs have been filed which show that roofs as well as walls to a substantial extent were damaged.
The learned Standing Counsel submitted that as the building is constructed in a small lane, modern equipment, such as, JCB, could not be taken, that the entire demolition work has to be carried out manually which was the reason why the structure as a whole could not be removed and that however the structures were removed in such a manner which cannot be reconstructed.
In the light of the above facts and the material which support the plea of the respondents that they have complied with the order of this Court in its spirit, if not in letter, the contempt case is closed. C.V.NAGARJUNA REDDY, J 08th July, 2016 VGB
