The petitioner, who is accused No.3 in C.C.
No.456 of 2014 on the file of the Additional Judicial Magistrate of First Class, Rayachoti, YSR Kadapa District, for the alleged offences punishable under Sections 20(i)(c)(iv)(vi) and (x) and Section 29(4) of A.P.Forest Act, 1967 and Rule 3 of A.P.Sandal Wood and Red Sanders Wood Possession Rules, 1989 and Rule 3 of A.P. Sandal Wood and Red Sanders Transit Rules, 1969 and Section 379 I.P.C., filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail. The charge-sheet has already been filed in this case and the trial Court has taken cognisance of the said charge-sheet. N.B.W. is pending against the petitioner-accused.
Considering the facts and circumstances of the case, the petitioner-accused is directed to surrender before the Magistrate concerned and file petition to recall N.B.W. issued against him. Upon filing of such petition, the trial Court is directed to recall the warrant, pending against the petitioner, on the same day on his executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with one surety for a like
sum to the satisfaction of the said Magistrate. Further, the petitioner-accused is directed to report before the Respondent-Police daily between 10.00 AM and 5.00 PM for a period of one month.
With the above observation, the Criminal Petition is disposed of.
