Ganesh Pandurang Bhonsale v. The State Of Telangana
HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY Crl.P. No.9612 OF 2018 ORDER:
This criminal petition is filed under Section 482 Cr.P.C. questioning the inaction of the Principal District and Sessions Judge, Medak at Sanga Reddy District in S.C.No.215 of 2017.
It is the contention of learned counsel for the petitioner that earlier this Court issued direction to the Sessions Judge vide order dated 10.04.2018 in Crl.P.No.3910 of 2018 directing the Sessions Judge to decide S.C.No.215 of 2017 in accordance with law at the earliest and in any event not later than two months from the date of receipt of the order and accordingly, the Sessions Judge completed evidence on 06.07.2018. Later learned counsel appearing for the defence and learned Public Prosecutor advanced their arguments on 12.07.2018 and it was again adjourned to 16.07.2018, 19.07.2018, 25.07.2018, 31.07.2018, 08.08.2018, 14,08.2018, 17.08.2018, 20.08.2018, 23.08.2018, 28.08.2018 and 31.08.2018 for pronouncement of judgment.
But the judgment was not pronounced and again it is posted to today according to the information given by learned counsel for the petitioner. When the Sessions Judge heard arguments of learned counsel for the petitioner and the Public Prosecutor, the Sessions Judge has to pronounce the judgment immediately or on any other date fixed by the Court, but for one reason or the other, the Sessions Judge adjourning the matter from day to day though two months time has been elapsed after hearing argument.
In view of the circumstances stated by learned counsel for the petitioner, the Principal District and Sessions Judge, Medak is directed to dispose of S.C.No.215 of 2017 within a week from today and intimate the same to the registry in writing.
With the above direction, the criminal petition is disposed of. Pending miscellaneous petitions in the petition, if any, shall stand closed.
