HON'BLE SRI JUSTICE C.PRAVEEN KUMAR AND HON'BLE SRI JUSTICE T.AMARNATH GOUD FAMILY COURT APPEAL No. 193 of 2015 JUDGMENT:

The present appeal came to be filed under Section 19 of the Family Courts Act, assailing the order dated 02.06.2015 passed in O.P.No. 1200 of 2010 on the file of the Judge, Family Court, Ranga Reddy District at L.B.Nagar, wherein the application filed by the respondent-husband seeking divorce under Section 10(X) of Divorce Act, 1869, was allowed.

On 08.07.2015, this Court, while admitting the appeal, granted interim suspension, as prayed for. Pending appeal, the parties have compromised the matter before the elders and settled their disputes. In view of the settlement, they entered into a Memorandum of Compromise dated 22.11.2017, wherein the respondent-husband agreed to pay an amount of Rs.22 lakhs to the appellant-wife, out of which an amount of Rs.18 lakhs shall be paid to the appellant at the time of filing of the petition for withdrawal of the criminal case C.C.No. 940 of 2015 before the XIX Metropolitan Magistrate Court at Kukatpally, Ranga Reddy district, and the balance Rs.4 lakhs shall be paid at the time of withdrawing the present appeal.

Today, both the parties are present before the Court and they were identified by their counsel. When examined, both of them stated that they have settled their disputes. As seen from the record, both of them have been living separately since 2009. 4.

Having regard to the compromise entered into between the parties and as both of them have been living separately since 2009, and the possibility of reunion between them being very remote, we order dissolution of marriage by consent between the appellant and the respondent, in terms of the Memorandum of Compromise dated 22.11.2017.

F.C.A is accordingly disposed of. Miscellaneous applications, if any, stand closed.
