This criminal petition is filed under Section 482 Cr.P.C. to release the passport (G4179408), which is in the custody of Additional Judicial Magistrate of First Class, Kandukur for renewal since it is expired on 15.07.2017.

It is the case of the petitioner that the petitioner enlarged on bail by the Sessions Court and in a petition filed before this Court in Crl.M.P.No.9441 of 2013 in Crl.P.No.10331 of 2013, this Court issued direction on 16.09.2013 to the petitioner to surrender passport within seven days from the date of order, failing which the Station House Officer is directed to seize the passport and deposit the same before the Additional Judicial Magistrate of First Class. Accordingly, the petitioner surrendered passport within time. The trial is not yet commenced till date.

The only request made by learned counsel for the petitioner is that to enable the petitioner to renew his passport and redeposit the same before the Court below.

Learned Public Prosecutor did not raise any objection to grant relief.

As seen from the copy of passport placed on record, the passport was expired on 16.07.2017 and in case it is not renewed, the petitioner is not entitled to leave the country. Therefore, to enable the petitioner to renew his passport, the Additional Judicial Magistrate is directed to release the passport since the earlier passport was

already expired. After obtaining passport, the petitioner is directed to re-deposit the new passport obtained by him within a month from today.

With the above direction, the criminal petition is disposed of at the stage of admission.

Pending miscellaneous petitions in the petition, if any, shall stand closed.
