HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.9516 of 2018 ORDER :

This criminal petition filed under Section 438 Cr.P.C. by the petitioner/A.1, among ten or more accused, in Crime No.109 of 2018 of Central Crime Station, D.D., Hyderabad, registered for the offences punishable under Sections 406, 409, 411, 414, 418, 420, 467, 468, 471, 474, 477(A) and 120(B) IPC.

Heard learned counsel for the petitioner and learned Public Prosecutor, representing the State, and perused the material on record. 3.

A perusal of the accusation, leave about earlier went unsuccessful before the learned Sessions Judge, Hyderabad, in Crl.M.P.No.2020 of 2018, dated 20.07.2018, and an application for anticipatory bail filed before this Court was withdrawn when not inclined, there is an embezzlement of the amounts of the entity of the de facto complainant, which the de facto complainant mentioned about Rs.10 crores in a course of time of three to four years by the petitioner along with the sub-staff under his control i.e., the other accused.

A perusal of the case diary shows, there is prima facie accusation, as rightly pointed out by the learned Public Prosecutor, and thereby this is not a fit case to grant anticipatory bail.

Accordingly, the criminal petition is dismissed. Needless to say, if at all the petitioner surrenders, remedy is left open to decide regular bail on own merits.
