THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.29785 OF 2017 ORDER:

Petitioner claims that he is the owner of land to an extent of Ac.0.70 cents in Survey No.305-3A, Ac.0.09 cents, an extent of Ac.0.09 cents in Survey No.305-2C, an extent of Ac.1.63 cents in Survey No.307-2C and an extent of Ac.0.63 cents in Survey No.0.63 cents in Survey No.307-3B of Kappalabanda Village, Puttaparthy Mandal, Ananthapur District. Petitioner intends to dispose of the subject property. When the petitioner's vendor approached the Sub-Registrar for registration, the registering authority refused to register the document on the ground that the subject land is an assigned /Government land and prohibited under Section 22-A of the Registration Act and therefore, cannot be processed for registration.

Learned Government Pleader, on instructions, would submit that the Commissioner of Land Administration has issued orders dated 08.02.2016 notifying inclusion of the subject property in the prohibited list.

If the petitioner is aggrieved by such inclusion or aggrieved by refusal of the Sub-Registrar to register the document, he has to avail remedies as available in law. 4.

Leaving it open to the petitioner to work out his remedies as available in law, the Writ Petition is dismissed.

There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand dismissed.
