THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.18945 of 2010 ORDER:

This writ petition is filed for the following relief: "For the reasons stated in the accompanying affidavit, it is prayed that the Hon'ble Court may be pleased to pass order or writ more particularly one in the nature of writ of mandamus declaring the inaction on the part of respondent Nos.1 to 5 in taking steps to stop the unauthorized opening of a school under the name and style of Nellore's Ravindra Bharathi School or on any name in the residential premises of respondent No.6 bearing Door No.40-25-19B, Seetharamnagar, Patamatalanka, Vijayawada-10, as illegal, arbitrary and high handed and consequently to direct respondent Nos. 1 to 5 to take immediate steps and to pass necessary orders in that regard and to pass such other relief or reliefs as this Hon'ble Court may deem fit and proper in the circumstances of the case."

When the matter is called, it is represented by the learned Government Pleader for Education that vide proceedings in L.Dis.No.75/C3/2012, dated 07.06.2012, the District Educational Officer, respondent No.1 herein, granted permission in favour of respondent No.7.

Therefore, the relief sought in the writ petition cannot be entertained now. However, it is open for the petitioner to question the validity of the proceedings, dated 07.06.2012, if it is advised to do so.

For the above observations, the writ petition stands closed. There shall be no order as to costs.
